What is Beyond Reasonable Doubt

Kinaree Eichner explains the burden of proof in criminal trials known as "beyond a reasonable doubt" and shows how it protects those accused of crimes in court.

Police Encounters

An arrest warrant is a piece of paper signed by a judge that allows the police to arrest you and take you to jail. But to get that arrest warrant the police need more than just suspicion. They would need to explain to a judge that they have a good reason to believe you committed a crime. That is called “probable cause.” That means that a reasonable person would be believe that criminal activity has taken place. That arrest warrant is based on the 4th amendment and is supposed to protect you from unlawful arrest.

First Amendment

Speech means more than just what we say. The Supreme Court says that freedom of speech
includes the ability to protest (even at school), dress a certain way, and create music, movies, and
Tv shows the way we imagine.

What is a Constitutional Amendment

There have been 27 amendments since the Constitution was written. Passing an amendment is
not easy but many amendments have made huge improvements for our country, like abolishing
slavery and giving women the right to vote.

What is the Difference between the Constitution and the Bill of Rights

The Constitution set up rules and regulations for the U.S. government, but it didn’t really talk
about what the government can do to you or for you. So, two years after the Constitution was
written, the founding fathers agreed to add 10 new “amendments.” An amendment means an
addition. They didn’t want to change the Constitution, so instead, they added new sections.

What is the Constitution

You might have heard of the Constitution on tv, in the news, or in history class. But what is it
exactly? First, the history: it all started back in 1788 when a group of representatives from each
of the American colonies came together to form a new, united government. These representatives
are often referred to as the “founding fathers” - and they met to write the Constitution, which is,
by the way, 4,543 words long, but who’s counting?

Prosecutor Clay Franklin and his buddy are back at the office watching porn but on the other side of town a more meaningful event is taking place. Education.

Deep voice. Silky-smooth and self-reliant. Inspiring his students. The art history class is taking place in an inner-city D.C. high school. Legendary teacher Bradford Slater is ripping through a slide of the Coronation of the Virgin painted in 1414. Slide after slide of paintings from the Uffizi Gallery in Florence, Italy, the ghetto outside seemed to disappear. A single gunshot at close range kills him. Even a community used to violence is stunned. Chalk lines surround a selfless educator and idol. A troubled student is the prime suspect. His father, a cop. Another day, another homicide, but this one is different. Way different.

Set in the courtrooms of our nation’s capital, D.A. Diaries explores the explosive combat zone of urban trial law through the eyes of Clay Franklin, an experienced homicide prosecutor. The high-profile trial of a police officer’s son accused of killing an enormously popular D.C. teacher is assigned to Clay. Clay is equally dedicated to chasing women as bringing murderers to justice. Saddled with an unforgiving and punishing workload of violent offenders, Clay tries to dodge work when he can, preferring, well, what most 30-something guys want. Spoiler alert: to party. But that changes.

Clay reconnects with the woman of his dreams. Crazy Buddha-Bar music played in the background. Their passion had been locked away in mineral silence for nearly a decade. But the euphoria of Clay’s relationship is overwhelmed by a progression of devastating events as witnesses go silent, and a corrupt clan of police officers seeks to protect the prime suspect. The evidence is way off. Witness interviews, forensic evidence, motive – nothing lining up. But that doesn’t slow the political pressure to bring the kiddie-killer to justice.

Then it goes from weird, to bad, to worse: Clay’s indiscretion with a witness from the case threatens both his personal life and his career, sending the superstar of the homicide unit into the abyss. Despite entering a jet-fueled burning hell of misfortune, he has to get through his murder docket, a “waiver hearing” to determine if the teenager can be tried as an adult, and then pick a jury with eyes wide shut as to who did what.

Clay is a passionate individual, revealed through his observations and conversations with his cynical pals at the D.A.’s office, crooked cops, drug-addled witnesses, and his burned-out psychiatrist. He sees the legal system, his dysfunctional family, and our nation’s capital through a unique lens that is at once comedic, troubling, and honest.

In this clip from his CLE entitled "The Use of Experts in County, State, and Federal Courts," Ken Eichner use an example from his work on an alleged domestic violence case in county court to demonstrate the power of the "expert hypothetical." In his case, Ken called upon a forensic expert to demonstrate that pictures of alleged prior abuse were likely not the result of domestic violence, but rather the result of horseplay at an Ultimate Fighting party. The witness being discredited, Ken's client was ultimately acquitted of all charges.
